Suivant vos commentaires et idées, nous affinerons la sélection jusqu’à ce que nous ayons une sélection optimale pour vous. Une fois que vous avez organisé un voyage en Espagne, nous allons organiser les visites et nous vous conseillons sur toutes les propriétés et voisinages. Ensuite, nous vous assisterons à l’achat et après, si vous le souhaitez. Nous coopérons avec un large réseau d’agents professionnels et sommes également en mesure d’offrir un service d’achat complet en collaboration avec d’autres sociétés immobilières ; les avocats, les comptables, les agents financiers et d’autres services qui pourraient simplifier votre achat ou fournir d’autres avantages.

Tout ce dont nous avons besoin de votre part sont vos critères et vos souhaits concernant la propriété ;

Une fois que la propriété parfaite est trouvée, une première offre d’achat est faite. En Espagne, il est assez rare que le prix d’achat ne soit pas négocié. Nous vous conseillerons en là-dessus. Une fois que nous avons obtenu votre prix d’achat, un contrat de réservation est fait et vous payez un montant de réservation entre 3 000 et 6 000 € pour enlever la propriété du marché. Cet argent est soit transféré à votre avocat ou à nous. Cet acompte sera conservé dans votre compte client chez votre avocat jusqu’à la signature finale du contrat d’achat. Si l’achat n’a pas lieu et que les négociations se terminent avec la faute du vendeur, l’acompte sera remboursé.

L’Espagne a des lois strictes sur le blanchiment d’argent. Pour prouver la légalité de l’argent, vous devez fournir les informations suivantes à votre avocat et à votre agent immobilier :

  • Copie du passeport pour tous les acheteurs
  • Adresse de résidence complète
  • Facture d’électricité dans votre nom datée des 3 derniers mois
  • Description de la source d’argent pour l’achat

Votre avocat vérifiera alors le cadastre pour s’assurer que la propriété est correctement enregistrée et qu’il n’y a aucune hypothèque ou d’autres frais. L’avocat organisera également le paiement avec le représentant du vendeur avant d’aller chez le notaire et de préparer un contrat liant les deux parties. En règle générale, un contrat de vente privé est conclu et 10% du prix d’achat sont payés quelques semaines avant le contrat final de vente. Le contrat de vente privé fixe la date de la vente et les avocats préparent les documents publics à la signature d’un notaire espagnol.

En Espagne, un acheteur doit également obtenir un NIE (Numero de Identificacion de Extranjeros), qui est un numéro d’identification officiel pour les étrangers. Ce numéro doit être obtenu avant l’achat final la propriété. Votre avocat peut organiser cela pour vous.

Il est également important d’ouvrir un compte bancaire espagnol avant d’acheter afin que votre avocat puisse organiser des ordres pour les paiements courants de la propriété et les taxes. Les paiements en provenance de l’étranger pour la taxe foncière, l’eau et l’électricité ne sont pas acceptés.

Le jour de l’achat, l’Escritura (acte de propriété) ne sera signé qu’après que votre avocat ait effectué tous les contrôles pertinents et confirmé que le bien immobilier soit libre de dettes et autres réclamations. Votre avocat aura arrangé le paiement à l’avance avec le vendeur. Les chèques avec garantie bancaire sont la méthode de paiement préférée en Espagne. Il est donc possible de transférer l’argent à l’avance sur le compte bancaire de votre avocat afin que ce dernier émette le chèque pour vous. Votre avocat organisera tout dont vous avez besoin pour aller chez le notaire.

Si vous-même ne pouvez ou ne voulez pas assister personnellement à la signature chez le notaire, une procuration pour l’avocat est suffisante pour vous représenter. Le moyen le plus simple d’accorder cette procuration est d’aller voir un notaire en Espagne avec votre avocat. Toutefois, cela peut également être organisé par les consulats espagnols ou par un notaire local à votre lieu de résidence, ce qui, cependant, entraîne des coûts beaucoup plus élevés. Tous les acheteurs et les prêteurs hypothécaires doivent être représentés par des procurations à la signature.

 

FRAIS D’ACHAT ET TAXES D’ACHAT

Lors de l’achat d’une propriété de revente, l’acheteur doit payer une taxe de vente de 8%, appelée en espagnol «Impuesto de Transferencia de Propiedad» (ITP).

Pour les nouveaux bâtiments, il existe un taux fixe de 10% IVA (TVA).

Les frais de notaire peuvent varier en fonction du nombre de pages ou de la complexité de l’acte de propriété, mais sont généralement de l’ordre de 0,5% du prix d’achat. Il y a aussi des frais de registre foncier d’environ 0,3%.

Les frais juridiques s’élèvent à 1% du prix de vente.

 

Hypothèques

Si vous avez besoin d’une hypothèque, nous pouvons vous recommander un conseiller financier indépendant spécialisé dans les emprunts pour les étrangers. En Espagne les non-résidents peuvent obtenir un financement maximum entre 70 et 80% de la valeur du bien immobilier.
